CONDITIONS OF USE OF THE TSC SERVICE

Introduction
Welcome to The Social Cashback ! These Terms of Use govern the use of the The Social Cashback platform, operated by TIK JOY Inc., headquartered at 1101 Madison Street, APT 503, New Jersey, United States.

Description of the Service

The Social Cashback offers a technological platform that enables Users to:

  • Sharing pre-configured content (e.g. promotional videos) via social networks such as TikTok or WhatsApp for rewards in the form of cashback.
  • Manage accumulated credits, redeemable according to the conditions specified by the partner companies.

Access to and use of the service by Users are governed by these Terms and applicable regulations.

Registration and User Obligations

To access the service, the User must:

  • Register by providing correct, up-to-date and truthful personal information.
  • Ensure the security of one’s access credentials, undertaking not to share them with third parties.

The User also undertakes to

  • Use the service exclusively for personal and lawful purposes.
  • Do not upload content that is illegal, offensive, defamatory, discriminatory or infringes the rights of third parties, including intellectual property rights and privacy.
  • Avoid any use of the service that may compromise its security, integrity or functionality.

The Social Cashback reserves the right to suspend or revoke access to the service in the event of violations of these Terms and Conditions or behaviour deemed inappropriate.

How Cashback Works

The cashback provided by The Social Cashback represents a monetary reimbursement granted to Users in relation to specific actions performed on the platform, such as logging in, sharing content or other promotional activities defined by partner companies.

Accumulation modalities and requirements

  • Accumulation: Users only accrue the right to cashback following the complete and compliant execution of actions requested by the platform or business partners (e.g. sharing a promotional video on a social network).
  • Validation: The Social Cashback, through its proprietary algorithm, verifies and allocates the cashback amount based on the actions performed and the conditions set by the associated partner.

Cashback disbursement

  • Cashback accrued by Users is credited in money directly to the bank account indicated by the User upon registration or in a dedicated section of the personal profile.
  • To receive the disbursement, the User must:
    • Provide a valid bank account in the same name or co-owned by the same User.
    • Reaching the minimum credit threshold required for disbursement, as specified by the platform or partner companies.
    • Ensure that your current account information is correct and up-to-date.

Timing and method of payment

  • Payments will be made by The Social Cashback within 30 working days of reaching the minimum credit threshold, unless there are technical or administrative impediments.
  • The User will receive an email notification confirming the successful crediting or any issues requiring further information.

Limitations of liability

  • The Social Cashback is not liable for delays in the provision of cashback due to:
    • Errors or incompleteness in the bank data provided by the User.
    • Malfunctions of the banking system or external payment platforms.
  • The Social Cashback reserves the right to suspend the payment of cashback if there are well-founded doubts as to the legitimacy of the User’s activities or compliance with the requirements.

Exclusion Cases

  • Users will not be able to claim cashback:
    • In case of violation of these Terms of Use.
    • If the accumulated credits do not reach the minimum threshold necessary for payment.
    • For activities deemed fraudulent or not in conformity with the platform rules.

Transparency and support
Users can monitor the status of their accrued credits and payments directly from their account on the platform. For any queries or clarifications regarding the provision of cashback, The Social Cashback provides a dedicated support service, which can be reached by email at info@tik-joy.com.

With these arrangements, The Social Cashback strives to ensure a simple, transparent and User-friendly cashback system.

In the event that the User exercises his or her right of withdrawal on a purchase for which he or she has received a cashback through the The Social Cashback service, the User acknowledges his or her obligation to return to The Social Cashback the full amount of the cashback previously paid in respect of that purchase.

The Social Cashback will be entitled to recover the amount of the cashback in any lawful manner, including by direct withdrawal from the User’s account associated with the service or, if necessary, by legal action. To enable the recovery of the amounts, the User undertakes to issue The Social Cashback with any necessary proxies, including a SEPA authorisation for automatic withdrawal from the account.

The User also acknowledges that failure to fulfil this obligation will result in immediate suspension of access to the The Social Cashback services, without prejudice to TIhe Social Cashback ‘s right to take legal action to recover the sums due.

Limitations of Liability

The Social Cashback provides the service “as is” and does not guarantee that it is error-free, uninterrupted or completely secure.

The company is not liable for:

  • Misuse of the service by Users.
  • Content, data or materials uploaded by Users onto the platform.
  • Technical malfunctions due to external factors, such as interruptions in social network services or problems with the technological tools used.

The User agrees to indemnify and hold The Social Cashback harmless from any liability arising from claims, damages or losses caused by his/her use of the Service, except in the event of gross negligence or wilful misconduct directly attributable to The Social Cashback.

Rights and Duties of the User

The User has the right to:

  • Access to the platform and use of the services within the limits of these Conditions.
  • Receive technical assistance for any problems with the operation of the platform.

The User has a duty to:

  • Use the service in a manner consistent with applicable laws and these Terms.
  • Ensure that the content uploaded on the platform does not infringe third-party rights.
  • Do not use the service for commercial purposes, unless otherwise authorised in writing by The Social Cashback.

Changes to the Terms of Use

The Social Cashback reserves the right to change these Terms at any time. Users will be given at least 30 days’ notice of any changes. By continuing to use the service after this period, you implicitly accept the new Terms.

Processing of Personal Data

The Social Cashback processes your personal data in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and applicable legislation. For more details, please see our Privacy Policy available on the platform.

Applicable Law and Jurisdiction

These Conditions are governed by Italian law. For any disputes with consumer Users, the court of the place of residence or domicile of the User shall have jurisdiction, as provided for in Article 66-bis of the Consumer Code (Legislative Decree 206/2005).
